Terms of Use

These Terms of Use (“Terms”) govern your use of the Tubely iOS app, operated under the name “Tubely”. By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

Eligibility

Tubely plays content from YouTube, so you must meet the age requirements of the YouTube Terms of Service and comply with those terms while using the app. If YouTube’s terms do not permit you to use YouTube, you may not use Tubely.

Personal, non-commercial use

Tubely is for your personal, non-commercial listening. Any other use — including commercial playback, redistribution, or resale of access — is not permitted.

Limited license

Tubely grants you a limited, non-exclusive, non-transferable, revocable license to install and use the app on Apple devices that you own or control, solely as permitted by these Terms and the App Store’s usage rules. Tubely and its name, logo, and design remain the property of their owner; no other rights are granted.

Acceptable use

You agree not to:

  • Use the app for anything unlawful or to infringe the rights of creators and rights holders.
  • Circumvent, or attempt to circumvent, the playback-only nature of the app — for example by extracting, downloading, recording, or redistributing content.
  • Interfere with or disrupt the app or the YouTube services it relies on.
  • Use the app to scrape, bulk-collect, or abuse YouTube in ways its terms prohibit.
  • Reverse engineer the app except where that restriction is prohibited by law.

YouTube content

All music, videos, artwork, and metadata available through Tubely are owned by their respective creators and rights holders and are provided via YouTube. Tubely claims no ownership of that content and grants you no rights to it. Your access to and use of YouTube content through the app is subject to the YouTube Terms of Service, including its age requirements and its restrictions on how content may be used. Playback in Tubely is foreground streaming inside the app.

Service availability

Tubely depends on YouTube’s services. Features may change, degrade, or stop working if YouTube changes or restricts its services, and content may become unavailable at any time. Tubely does not guarantee uninterrupted or error-free operation and may modify, suspend, or discontinue the app (in whole or in part) at any time.

Disclaimers

The app is provided “as is” and “as available”, with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, Tubely disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by applicable law, Tubely will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of or related to your use of the app. Tubely’s aggregate liability for any claim relating to the app will not exceed the amount you paid for the app — which, while the app is free, is zero.

Termination

Your license to use the app ends automatically if you breach these Terms. You may stop using the app at any time by deleting it from your device. Tubely may also withdraw the app or restrict access to it at any time.

Changes to these Terms

Tubely may update these Terms from time to time. The current version is always posted on this page with its effective date. By continuing to use the app after updated Terms take effect, you accept the changes.
